If you enter the 'European Tour Fantasy Race to Dubai 2017' game (the “Game”) through the web site located at http://www.europeantour.com/myeuropeantour/fantasyrace, http://fantasyrace.europeantour.com/ or such other web site as may be specified (the “Website”) then you are bound to play within these terms and conditions of play (the “Terms and Conditions”) as specified by the promoter of the Game, EngageCraft Ltd, 16 Upper Woburn Place, London WC1H 0AF (the “Promoter”).
The Promoter organises and operates the Game on behalf of PGA European Tour Productions Limited (“the European Tour”).
These Terms and Conditions apply to all users of the Game (“Users”). Entry into the Game is open to both UK and non-UK residents.
ENTRY REQUIREMENTS: Registration details for the Game must be entered immediately before team selection. Any team entries received before 00:00 GMT on 19 January 2017 will earn points for the first tournament of the Game. After that, only teams entered before the tournament cut-off deadline of a tournament will earn prize money for that event. In general the registration cut-off deadline is 00:00 the day the tournament starts, but this may vary from time to time (at the sole discretion of the Promoter) so Users are advised to check the My Team page, where the deadline is stated under ‘Deadline’ (such deadline being, the “Cut-Off Deadline”).
Incorrect, incomplete or corrupted entries for the Game will not be accepted and the Promoter accepts no liability in respect of the same. In all cases, the computer record of the entry will be considered to be the User’s entry for the purposes of the Game. The decision of the Promoter is final.
There is a strict one team per User policy for the Game regardless of whether or not a User has more than one My European Tour account (under different email addresses).
Users must be over 18 years old as of 19 January 2017 to be eligible to take part in the Game.
Employees of the Promoter and the European Tour, their associated companies, their relatives, agents or agents' relatives are ineligible compete in the public version of the Game and/or to win any prizes in the Game. If such person would otherwise win a prize, it shall be awarded to the next placed user.
No purchase of any item or service is necessary in order to enter the Game and no payment is required from you to enter the Game. The sole consideration required from you is that you agree to be bound by these Terms and Conditions.
Any personal information which you submit will be controlled in accordance with the privacy policies of the Promoter and the European Tour, and all UK legislation governing the same.
TEAM NAMES: The Promoter reserves the right to refuse team names that are deemed in its sole discretion to be inappropriate or offensive. Unsuitable team names will be changed to the user’s name without notice to the User. Repeated use of inappropriate or offensive team names may lead, at the Promoter’s sole discretion, to a User’s team being removed from the Game entirely.
PLAYER LIST: The golfers included on the selection list for the Game have been determined by European Tour and the Promoter. Neither party will enter into any correspondence relating to details of these lists, nor will they accept the inclusion into a User’s team of any golfer not included on the published list. Players may subsequently be added to the initial player list at the discretion of the Promoter and the European Tour as and when they secure eligibility for European Tour membership.
SCORING: Points are awarded to players within the Game based on the actual European Tour points (rounded to zero decimal places) in 2017 European Tour events, starting with the Abu Dhabi HSBC Championship on 19 January 2017. Users also must select a captain for their team, whose points will be doubled. Full points scoring information is available on the Game Rules page. The Game Rules form part of these Terms and Conditions.
TEAM CHANGES: After 11:00 GMT/BST on Monday following the completion of a tournament Users will be able to make unlimited changes to their team ahead of the next tournament. This includes unlimited changes to their captain. To score points for the next tournament all changes must be made before the Cut-Off Deadline for the next tournament. GENERAL CONDITIONS: The rules and points structure are all copyright of European Tour. No information may be reproduced in any format without prior written consent from the Promoter and European Tour.
Informative and explanatory copy relating to the Game including the scoring system and rules, shall be deemed to be incorporated into, and form part of, these Terms and Conditions.
The Promoter shall be the sole decision-maker of any matter of interpretation of the Game Rules and any aspect of the content of, or playing of, the Game. The Promoter will not enter into correspondence relating to such matters and its decision as to any matter arising out of or in connection with the Game Rules.
The Promoter and the European Tour reserve the right to refuse to accept any entry which, in their opinion, does not comply with the rules and regulations of the Game or which contravenes the spirit of the Game. The Promoter has an absolute discretion to disqualify any entry, or vary, amend or waive these Terms and Conditions at any time and participants agree that no liability shall attach to the Promoter and/or the European Tour as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any User. It is a condition of entry that all Terms and Conditions are accepted as final and that the User agrees to abide by these Terms and Conditions.
The Website may not be available at all times. The European Tour, the Promoter and their associated and subsidiary companies cannot be held liable if the Website is unavailable at any time and do not accept liability for technical, hardware or software failures of any kind or lost or unavailable network conditions which may limit or prohibit the opportunity to participate in the Game.
The Promoter reserves the right to immediately remove from the Game without prior notice any Users found to be attempting or suspected of attempting to hack into the systems of the Promoter or the servers used to host the Game. Such Users will have no right to any of the Game’s prizes and the Promoter reserves the right to report the matter to the relevant authorities.

The Prizes are made available at the discretion of the Promoter and European Tour and the Prizes may be altered, amended or withdrawn at any time without prior notice to Users. Prizes are not transferable and are non-exchangeable and no cash alternative shall be offered in any circumstances.
In the event of a tie for any Prize, the Users that submitted their initial selections (as part of registration for the Game) earliest will be deemed the winner. Winners will be contacted by email via the contact details entered the registration process. In the event that a User does not respond to a winning notification within 28 days of the date of the notification, the Promoter reserves the right to pass the Prize to a corresponding runner-up.
Prizes will only be awarded to the User whose name is originally submitted on the registration form. If a prize winner does not wish to accept a Prize, then the Prize may be passed to the corresponding runner-up.
The winning Users’ names and photographic images and their comments relating to any Prize may be used limitation for future promotional, marketing and publicity purposes of the Promoter and European Tour in any and all media worldwide without notice to them and without any fee being paid.
LIABILITY: If any of these terms are determined to be illegal, invalid or otherwise enforceable then the remaining terms shall continue in full force and effect.
While the Promoter will endeavour to ensure that the Game is available to Users at all times and that the contents of the Game are accurate and correct, it does not make any warranty or representation in respect of the same.
The Promoter reserves the right to suspend, cancel or amend the Game at any time where it becomes necessary to do so.
In no event shall the Promoter or the European Tour be liable to Users for any indirect, special or consequential losses.
Nothing in these Terms and Conditions shall limit the liability of the Promoter and the European Tour for death or personal injury arising from its negligence, fraud or fraudulent misrepresentation, or any other liabilities which cannot be excluded as a matter of law.
These Terms and Conditions shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
